Areas of Practice
- All Canadian immigration and citizenship matters, including immigration litigation and enforcement, assisting Canadian employers with hiring and maintaining a foreign workforce, and the transfer of employees across international borders.
Joel received a Bachelor of Arts degree in Political Science from the University of Alberta in 1995 and his law degree from Osgoode Hall Law School at York University in Toronto.
While in law school, Joel represented low-income clients in immigration matters through the Community and Legal Aid Services Programme, where he became an Immigration Division Leader in 1996. During law school, Joel also participated in an intensive program in Immigration and Refugee Law.
Joel regularly appears before all three Divisions of the Immigration and Refugee Board and in the Federal Court of Canada, representing clients in detention reviews, refugee hearings, sponsorship appeals, deportation appeals and applications for judicial review as well as other types of enforcement matters.
In addition to representing his clients, Joel assists in training law students at CLASP (Osgoode Hall Law School) and helps train Dispute Resolution Officers at the Appeal Division of the Immigration and Refugee Board.
Joel is regularly interviewed by members of the news media concerning developments in immigration and refugee law. He has written numerous articles in the Criminal Lawyers Association Newsletter, the Migration Law Review and the Corporate Relocation Quarterly.
Recent Cases
- Ferrer v. Canada (Minister of Citizenship and Immigration) (2009) FC 356 Overturning a decision of the Immigration Appeal Division dismissing the appeal of a Permanent Resident who was inadmissible for having made a material misrepresentation to Immigration Canada.
- Blake v. Canada (Minister of Public Safety and Emergency Preparedness) IADD TA7-13571 Granting a stay of execution of a removal order against a permanent resident who had been convicted of serious firearms offences.
- Mahant v Canada (Minister of Citizenship and Immigration) IADD TA7-03356 Overturning the decision of a visa officer refusing a family class application where the Canadian sponsor suffered from Asperger's syndrome.
- Waweru v. Canada (Minister of Citizenship and Immigration) IADD TA7-06788 Overturning the decision of a visa officer refusing a sponsorship application where a sponsor was alleged not to have disclosed the existence of his child when he became a landed immigrant, preventing his examination.
